These Terms of Service (“Terms”) govern your access to and use of the Services provided by Red Panda Leads, LLC, a Delaware limited liability company (“Red Panda Leads,” “Company,” “we,” “us,” or “our”). These Services include our websites at redpandaleads.com, app.redpandaleads.com, and all affiliated subdomains (collectively, the “Platform”), as well as our software and lead delivery system for real estate investors.

By accessing or using our Platform or Services, you agree to be bound by these Terms. If you do not agree, you may not access or use our Services.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use our Services.

2. Services Overview

Red Panda Leads provides off-market lead generation services for real estate investors through proprietary software and marketing technology. Users may purchase leads individually or via subscription packages. These leads are delivered digitally and accessible through our user portal.

Disclaimers:

• Leads are not guaranteed to be motivated sellers.
• Marketing and skip-tracing methods are proprietary and confidential.

3. Account Registration

To access certain features, you must register for an account. You agree to provide accurate, complete, and updated information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

4. Lead Usage and Restrictions

You agree to use the leads solely for your internal business purposes. You may not:

• Resell, share, or redistribute leads without our written consent.
• Use the Platform for unlawful, deceptive, or unethical purposes.
• Attempt to gain unauthorized access to the platform or other users' data.

5. Payment, Billing, and Subscriptions

When you purchase leads or subscribe to a package:

• You agree to pay all fees as posted at the time of order.
• You authorize recurring billing if applicable.
• You acknowledge that all purchases are governed by our Refund Policy below.

Payments are processed through third-party providers. Red Panda Leads does not store payment details.

6. Refund Policy

At Red Panda Leads, we aim to provide investors with the highest quality leads possible. While we cannot guarantee that every lead will result in a transaction, we have established a refund policy to support fair use and partner success.

Refund Request Process

You have 7 calendar days from the time a lead is delivered to request a refund.

All refund requests must be submitted via email to contact@redpandaleads.com and include:

• Lead ID
• Reason for the refund
• Supporting documentation (e.g., screenshots, call logs, links)

Refunds are reviewed within 1–7 business days and, if approved, will be credited to your account balance for future purchases. Refunds are not returned to original payment methods unless explicitly agreed.

We follow up with leads submitted for refund to verify claims.

Refunds Will Not Be Issued For:

• Leads indicating a willingness to sell within 6 months.
• Leads with valid contact information but no response.
• Leads that do not convert to a deal.
• Leads generated outside of the Red Panda Leads system.
• Refund requests submitted after 7 calendar days from lead delivery.

Refunds May Be Approved For:

• Outside Target Area — Property is outside your defined buying area. Include public documentation (Zillow, Assessor, etc.) proving location.
• Spam or Fake Leads — The contact information or identity is fictitious or invalid. Include supporting evidence.
• Invalid Contact Information — Both phone and email are invalid. If email is valid, you must demonstrate 4 days of follow-up attempts before refund eligibility.
• No Response — No seller response after 12 contact attempts over 4 consecutive days using calls, texts, and emails (minimum of 3 daily touch points). Logs required.
• Vacant Land or Non-Residential — Properties without a residential structure. Include property records.
• Mobile Homes in Parks / Rented Land — Mobile/manufactured homes not sold with the land. Submit confirmation link or documentation.
• Active MLS Listing (For Sale) — Property is actively listed for sale on the MLS. Provide live listing links. Note: “For Rent” or agent-owned properties not listed for sale are not refundable.
• Wholesaler Leads — Contact is a wholesaler not on title. Supporting documentation required.
• Not Selling — Seller states they are no longer interested in selling. Include proof of communication.
• Seller Didn't Submit Form — Seller denies submitting the inquiry. Proof required.
• Duplicate Leads — Identical property leads received within 30 days from Red Panda Leads. Include both lead IDs. Duplicates from other platforms are not eligible.
• Other — If your situation doesn't fit these categories, provide a detailed explanation and supporting documentation for consideration.

Appeals Process

If your refund is denied, you may appeal within 3 business days by emailing contact@redpandaleads.com. Include:

• Lead ID
• Summary of your case
• Any additional documentation

Best Practices and Policy Notes

• Excessive refund requests may impact your lead flow or bidding status.
• We recommend optimizing outreach strategies (e.g., A/B testing, triple dialing).
• We reward active and engaged lead buyers with more consistent lead access.

7. Intellectual Property

All content, software, marketing methods, and branding are the sole property of Red Panda Leads, LLC. You may not reproduce, reverse engineer, license, or redistribute any portion of our platform or intellectual property without written authorization.

8. Indemnification

You agree to indemnify, defend, and hold harmless Red Panda Leads, LLC, its members, affiliates, officers, employees, and agents from any and all claims, liabilities, damages, costs, and expenses (including attorneys’ fees) arising out of:

• Your use or misuse of the Services;
• Your violation of these Terms;
• Any transaction, communication, or dispute between you and a seller lead.

9. Disclaimers and Limitation of Liability

Our Services are provided “as is” and without warranties of any kind, either express or implied. We do not guarantee:

• Lead responsiveness or motivation;
• Accuracy of submitted data;
• That leads will result in any business outcome.

To the maximum extent permitted by law, Red Panda Leads is not liable for indirect, incidental, punitive, or consequential damages. Our total liability is limited to the amount paid by you in the 30 days preceding the event giving rise to the claim.

10. Termination

We may suspend or terminate your account or access to Services without notice if:

• You violate these Terms;
• We suspect fraud, abuse, or unauthorized activity.

You may cancel your subscription at any time. All outstanding balances remain due upon termination.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed under the laws of the State of Delaware, without regard to its conflict of laws rules.

Any disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association. Arbitration will take place in a mutually agreed location. You waive the right to participate in class actions or jury trials.

12. Changes to Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting. Your continued use of the Services constitutes acceptance of any changes.
